A fence is a structure, a lawn is not
Regulators draw the line in the same place. The Oklahoma Insurance Department describes a tree “causing damage to a structure such as the house, garage or fence” and says that in that case “the cost to remove the tree or limb is also covered by the insurer.” The Texas Department of Insurance adds the other side of it: “limbs and trees falling in your yard usually aren’t covered.”
So a tree that crushed a section of fence is usually a different claim from one that landed on the grass beside it. Photograph the fence, the shed or the garage with the tree on it before anything is moved, and call your insurer or agent.
Other structures have their own limit
Fences, sheds and detached garages usually fall under a part of the policy for other structures, with its own limit. A tree-industry article in TCI Magazine explains that this limit is often set as a share of the coverage on the house, and gives the example of a tenth of $150,000, which would be $15,000. Your declarations page shows the actual figure.
When it is the neighbor’s fence
If your tree came down on a neighbor’s fence, or theirs on yours, the same rule as for houses usually applies: a healthy tree brought down by weather is nobody’s fault, and each owner claims on their own policy. The Oklahoma department notes the exception: if a neighbor is told a tree is a safety concern and does nothing, the neighbor “could be considered negligent.” A neighbor’s tree
What removal involves
A tree across a fence is often still attached to its stump and pressing down on the panels. The crew takes weight off in sections and leaves the fence posts to be repaired afterwards by whoever builds fences. If the tree is in a back yard, ask whether the crew’s equipment fits through the gate, or whether a section of the broken fence will be used as the way in.
